I adore the Apple TV

After all, as Julio Ojeda-Zapata (twincities.com) explains, Apple TV is a joy to use. And it proved a godsend for one of my familys recent movie nights when frigid temperatures precluded a trip to a video store. He downloaded Disneys The Game Plan, and the movie was ready for watching soon after the download initiated. Viewing was flawless; ditto for Garfield, another family-night rental. Mac OS X Secretly Cripples Non-Apple Software

spikedLemur writes "Vladimir Vukicevic of the Firefox team stumbled upon some questionable practices from Apple while trying to improve the performance of Firefox. Apparently, Apple is using some undocumented APIs that give Safari a significant performance advantage over other browsers. Of course, "undocumented" means that non-Apple developers have to try and reverse-engineer these interfaces to get the same level of performance. You really have to wonder what Apple is thinking, considering the kind of retaliation Microsoft has gotten for similar practices.

Apple, Starbucks Sued Over Music Gift Cards

Trintech writes "A Utah couple acting as their own attorneys have filed a lawsuit against Apple and Starbucks over the retailers' recent Song of the Day promotion, which offers Starbucks customers an iTunes gift card for a complimentary, pre-selected song download. In a seven-page formal complaint, James and Marguerite Driessen of Lindon, Utah say they developed in 2000, and were granted a patent in February 2006 for, an Internet merchandising utility dubbed RPOS (retail point of sale). The concept, which forms the heart of the infringement lawsuit, would allow gift cards for pre-defined items that can be sold at a brick-and-mortar store but used online; customers could redeem a card for a dining room set or a DVD, for example."

Unfortunately, the evidence provided, such as the media announcements that are usually made before most Apple releases, suggests that this may indeed be true. Apple Sends Cease-and-Desist To the Hymn Project

Troed writes "Tools for removing DRM from iTunes-purchased songs (myFairTunes7, QtFairUse6) have been available from the Hymn Project Web site for some time. These are legal in many countries. But on the 20th Apple sent a Cease and Desist note to Hymn's ISP, forcing the site admins to remove all download links. It is speculated that this is due to a new tool being created (Requiem) that attacks Apple's FairPlay DRM through cryptographic means instead of by copying the unprotected music from memory while it is being played. But since the tools are no longer available (after several days there are still no public mirrors), discussion around this topic has died out. Many users buy music from the iTunes store and rely on DRM removal to be able to play the content on their mobile phones. Apple may be on dangerous ground here, since those users might now start checking out competing services."

Multitouch Gesture Patents Could Prevent Standardization

ozmanjusri brings us a Wired report on Apple's efforts to patent the multitouch gestures used on their laptops, smartphones, and tablets. The article discusses concerns over how this could affect the standardization of certain gestures in developing multitouch technology. We've previously discussed the patent applications themselves. Quoting Wired: "If Apple's patent applications are successful, other manufacturers may have no choice but to implement multitouch gestures of their own. The upshot: You might pinch to zoom on your phone, swirl your finger around to zoom on your notebook, and triple-tap to zoom on the web-browsing remote control in your home theater. That's an outcome many in the industry would like to avoid. Synaptics, a company that by most estimates supplies 65 to 70 percent of the notebook industry with its touchpad technology, is working on its own set of universal touch gestures that it hopes will become a standard. These gestures include scrolling by making a circular motion, moving pictures or documents with a flip of the finger, and zooming in or out by making, yes, a pinching gesture."

iPhones Produced in China Smuggled Right Back in

Ponca City, We Love You writes "Factories in China produce iPhones that are exported to the United States and Europe and then smuggled right back in helping explain why Apple says it sold about 3.7 million iPhones last year while only 2.3 million are actually registered in the United States and Europe. For Apple, the booming overseas market for iPhones is a sign of its marketing prowess but also a blow to Apple's business model, costing the company as much as $1 billion over the next three years, according to some analysts. Since negotiations between Apple and China Mobile, the world's biggest mobile-phone service operator with more than 350 million subscribers, broke down last month, the official release of the iPhone in China has been stalled producing a thriving gray market. Copycat models are another possible threat to Apple in China. Not long after the iPhone was released, research and development teams in China were taking it apart, trying to copy or steal the design and software for use in iPhone knockoffs, or iClones and some people who have used the clones say they are sophisticated and have many functions that mimic the iPhone. "A lot of people here want to get an iPhone," says Shanghai lawyer Conlyn Chan."

Apple TV could change the way we obtain and consume video

Christopher Breen (macworld.com) gives a four-mouse (out of five) rating to Apple TV, Take Two. Breen says he was impressed by the look of the HD movies I rented and played on my 42-inch Panasonic plasma TV. And he was just as impressed by the sound. Live Free or Die Hards 5.1 sound track was nicely separated and huge through my 5.1 AV receiver. MacBook Air just what the road warrior has been waiting for

For a lot of people, says Ken Mingis (computerworld.com), smaller and lighter is better when it comes to their laptops. He considers MacBook Air one of the coolest-looking laptops to appear in years both in terms of size and hipness. It has a gorgeous display that looks sharper and brighter on the Air than it does on the regular MacBook. And, he says, waking it up from sleep mode took about 2 seconds, and the LED backlighting means the screen hit full brightness as soon as it was awake. As for performance: The Air feels just about as snappy as my MacBook Pro in day-to-day use doing the kinds of things most users will be doing: surfing the Web, firing off e-mails, text editing and light graphics work.

According to Jim Dalrymple (macworld.com), one of the goals for Xsan 2 was to make it easier for customers to set up a storage area network (SAN). One of the ways Apple has accomplished this is with the SAN Setup Assistant, which is integrated into Mac OS X Leopard Server or as an application that can be run on its own. Customers continue their love affair with iPhone

The best recent advance in the mobile telecommunications user space came not from a mobile telecom company but from Apple Inc. the iPhone. That, according to David Benjamin (EE Times) was the conclusion reached by a blue-ribbon panel of human behavior and technology experts at the Mobile World Congress in Barcelona, Spain. And, Benjamin points out, Anup Murarka, director of technical marketing for Adobe, cited a study showing that 77 percent of iPhone purchasers described themselves as very satisfied with their user experience.

iPhone customers lead mobile search stats

Macworlds Jonny Evans reports that Google has confirmed it has seen 50 times more searches from the iPhone than from any other mobile handset. We thought it was a mistake and made our engineers check the logs again, Vic Gundotra, head of Googles mobile operations told the Financial Times at the Mobile World Congress in Barcelona. Evans also indicates that O2 recently confirmed the iPhone to be driving unheard of data traffic on the mobile network.

The cellphone industry went to Barcelona to show off the latest and greatest phones and, once again, hardware took center stage. But, Victoria Shannon (New York Times) points out, software is growing in importance as smartphones, capable of accessing the Web, become more popular. So, Shannon continues, it was no surprise that many of the phones were iPhone clones with touch screens, sleek flat shapes and spare software interfaces. If my hunch is correct, writes Julio Ojeda-Zapata (TwinCities.com), business-class airliner cabins will be filled with corporate types whipping out their MacBook Airs for work amid admiring glances from seatmates. MacBook Air, after all, is one sexy portable, a laptop that screams luxury with its extra-bright display (a newfangled light-emitting-diode variant) and a full-size, backlit keyboard that has a great, firm feel. Reviewing MacBook Air for the Daily Telegraph, Claudine Beaumont notes that most of the staff there have found this lightweight laptop very impressive. MacBook Air, she indicates is a delightfully designed gadget, hewn from aluminum and glass, and draws amazed gasps from almost all who see it. Its hard to appreciate just how slim it is until you hold it for yourself. Apple has done well with Aperture 2.0, based on my test of ingesting and editing a batch of my own photos on a dual-core iMac, remarks Stephen Shankland in a recent article on CNET. Mac OS X 10.5.2 Update Brings Welcome Fixes

jetpack writes to make sure we're aware that Apple's OS X 10.5.2 update is available and that it contains plenty of improvements and fixes that users have been asking for. Macworld enumerates some of the big ones, saying that the update "shows Apple listens to users" (sometimes). A couple of the new features simply restore Tiger (10.4) capabilities that Leopard (10.5) had inexplicably withdrawn. You can now shut off the much-maligned transparency of the menu bar, and organize your Dock stacks hierarchically and display them as folders. And Apple has provided welcome access to common Time Machine functions in the menu bar.

Checking out Apple TV Take Two

Christopher Breen (macworld.com) takes us on a tour of Apple TV that begins with downloading the software update and ends with the big questionHows it look? To which Breen responds, Darned good. After renting Live Free or Die Hard. Breen reports that the picture is great on my 42-inch Panasonic plasma display. With a digital audio cable connected to my AV receiver the movie caused the receivers 5.1 Dolby Digital Audio light to glow and the resulting sound was bigger than anything Ive heard come out of the box previously.

3G iPhone on the Way?

mooseman93 wrote to point out Forbes is suggesting that if you haven't purchased an iPhone yet, you may want to wait just a little bit longer. Supposedly the next generation of iPhone will offer some substantial upgrades, including 3G capabilities. "To be sure, a 3G iPhone likely won't pop up over the next several weeks. The Unofficial Apple Weblog reported this week that Apple is hiring a television production firm in preparation for a high-profile late February announcement. That event, however, will likely detail the widely anticipated release of a software developer's kit for Apple's iPhone and iPod Touch. But the wait can't drag on much longer. AT&T is building out its high-speed wireless network as quickly as it can, announcing Wednesday that it will expand its 3G wireless broadband service to more than 80 additional cities by the end of the year for a total of roughly 350 markets."

Time-Warner Considers Per-Gigabyte Service Fee, After iTunes

destinyland writes "Time-Warner is now mulling a plan to charge a per-gigabyte fee for internet service. A leaked memo reveals they're now watching how many gigabytes customers use in a 'consumption-based' pricing experiment in Texas, which we discussed early last month. The announced plan was that they were considering a tier-based approach, as opposed to per-gigabyte fees. 'As few as 5 percent of our customers use 50 percent of the network,' Time-Warner complains, with plans to cap usage at 5-gigabytes, and more expensive pricing plans granting 10-, 20-, and 40-gigabyte quotas. Steven Levy at the Washington post suggests Time-Warner's real aim is to hobble iTunes, raising the cost of a movie download by $10 (or $30 for a high-definition movie). Eyeing Time-Warner's experiment, Comcast cable also says they're evaluating a pay-per-gigabyte model."

iPhone finishes a strong second in Q4 phone sales

Even after being on the market for less than half a year, reports Nancy Gohring (IDG News Service), more iPhones sold in the fourth quarter than Windows Mobile phones in the U.S., according to research from Canalys. The research suggest that iPhone had 28 percent of the U.S. converged-device market in the fourth quarter of 2007 with Research in Motion coming in with 41% and Windows Mobile phones with a 21% share.

Here's a refresher: Conference organizers challenged attendees to hack into a Macintosh laptop, with the successful hacker winning the computer and a cash prize. Winner Dino Dai Zovi found a QuickTime bug that allowed him to run unauthorized software on the Mac once the computer's browser was directed to a specially crafted Web page. Apple Can't Afford iPhone's Carrier Exclusivity

WirePosted writes with an ITWire article about the problems that Apple's AT&T exclusivity deal could pose in the coming years. Initially the company needed AT&T's commitment to the project, to ensure features like visual voicemail would work. With the iPhone a hit even at its current high price that no longer seems to be the case. Can Apple afford to stick to an exclusive carrier in the future? If for no other reason than consumer choice? "iPhones are being sold unlocked in the markets of Asia where you can't get them with a carrier plan, but they're also being bought and unlocked in the US and Europe. The message is that many and probably most iPhone buyers would like to be given a choice of carrier when they buy their iPhone. Some would be prepared to pay more as they do with other smartphones and buy their iPhone unattached to any subsidized carrier contract. The point is many consumers feel no loyalty to carriers and resent being forced to choose one."
